Topic description
The topic will examine subjects in the law of personal and corporate insolvency. Such subject areas include: the principles of insolvency law, the position of receivers, preferences, duties owed to unsecured creditors, litigation involving statutory demands, the administration provisions in corporate rescue, opportunities for use of Part X of the Bankruptcy Act, offences in insolvency, duties of insolvency professionals and priorities.
Educational aims
The topic aims to:

  • introduce students to the areas of insolvency law and practice that are currently in place in Australia
  • provide students with a sound understanding to apply the knowledge they gain
Expected learning outcomes
On successful completion of the topic, students should be able to demonstrate skills and knowledge in:

  • explaining the regulation that has been developed and enforced by Parliament and the courts to address insolvency for the corporate form and the individual
  • applying the main principles of insolvency law
  • researching insolvency law
  • critically evaluating insolvency law
  • writing on insolvency law for a practitioner audience
