| Winifred Agnew-Pauley | Principal Supervisor: Associate Professor Caitlin Hughes Associate Supervisor: Andrew Goldsmith Adjunct Supervisor: Alex Stevens | By thesis entitled: The police use of stop and search in England: A critical realist and ethnographic approach | Stop and search is a core policing practice that causes controversy globally. This thesis addressed the question of how stop and search operates in England, and how contexts and mechanisms influence outcomes. It did so by applying a critical realist approach that included: a realist review; ethnographic fieldwork across community policing teams; semi-structured stakeholder interviews; and analysis of quantitative data. The research found several contextual factors that influence stop and search, including historical tensions between the police and marginalised communities, inconsistent government messaging and a focus on low-level drug-related crimes. Several mechanisms were identified that drive stop and search, including being linked to the identity of a ‘proactive’ officer and over-targeting areas of lower socio-economic status. The thesis makes a significant and original contribution to criminological theory and knowledge by providing a novel and comprehensive framework and by proposing pathways that can reduce the harms that stop and search generates. |
| Ahmed Alhammad | Principal Supervisor: Associate Professor Hossein Esmaeili Khabr Associate Supervisor: Vivienne Brand | By thesis entitled: The obligations of parties in e-commerce under Saudi Arabian and Islamic law. ‘Compatibility of Modern Saudi Law with Traditional Islamic Law’ | This thesis examines parties' obligations in e-commerce under Saudi Arabian and Islamic law as an integral component of the Saudi Arabian constitutional system. It analyses the compatibility of traditional Islamic law principles, which are enforceable in Saudi Arabia, with modern e-commerce provisions. The conclusion is that Islamic law is highly compatible with these issues. However, particular areas may exhibit variations, necessitating the application of Islamic principles in specific ways. For instance, alternative means of applying Islamic principles, such as Almaslahat Almursala, which prioritises public interest, can be employed. Additionally, Saudi law is essentially harmonious with Islamic law, although some instances may not align with all four schools of Islamic law. The thesis recommends that the current Saudi Arabian legislation governing in e-commerce is deficient and insufficient. Consequently, it should be replaced by a comprehensive consumer protection law that safeguards consumer interests and incorporates general principles of traditional Islamic law. |

While demand for food assistance continues to rise, many models remain focused on short-term relief, constrained by limited resources and traditional charitable frameworks. Through qualitative research with key stakeholders, food assistance is examined as a range of business models shaped by complex systems of resource dependence. The research develops a three-level framework – system, community, and organisation – to guide more sustainable, coordinated, and dignified responses. By integrating Resource Dependence and Social Innovation theories, the thesis offers new insights into how food assistance can move beyond crisis response to become a catalyst for long-term wellbeing. The findings contribute to a growing body of work aiming to transform food assistance from emergency charity into integrated, socially-driven innovative models that empower individuals and communities while addressing the structural drivers of food insecurity. |
| Judi Storer | Principal Supervisor: Associate Professor Hossein Esmaeili Khabr Associate Supervisor: Josh Holloway | By thesis entitled: Diffusion of International Environmental Law Principles of Sustainable Development into Australian Climate Change Legislation and Case Law | Climate change impacts threaten to reverse decades of hard-fought quality of life improvements for millions. As the greatest global challenge of the 21st Century, climate change requires urgent action. Yet, the international community is failing in that task. Sustainable development scholars believe the international environmental law sustainable development principles provide the most appropriate framework for effectively mitigating climate change, while addressing other global issues such as poverty alleviation. However, to effectively address climate change, the sustainable development principles must diffuse into countries’ domestic climate change law. Yet, few studies have investigated how effectively this diffusion is occurring. Therefore, this research analysed 49 pieces of legislation and 260 court decisions to determine how ten sustainable development principles had diffused into Australian domestic climate change law. The research illustrates that the principles have generally failed to diffuse into Australian domestic climate change law and identifies numerous barriers to the principles’ effective diffusion. |
